About us
The Association is organized as a trade association and business league exclusively for educational, civic and related purposes as defined in Section 501(c) (6) of the Internal Revenue Code of 1986, as amended.
The goal of the Association is to recognize and support Florida franchisors in their efforts to be successful in business, for the mutual benefit of the Association’s Members, their franchisees and the community. The Association will provide a forum to meet and exchange ideas and information, furnish continuing education in business and legal subjects to Members, and support and encourage lobbying efforts, publicity and educational endeavors which reflect favorably on licensing and franchising methods of doing business. The Association will support and cooperate with other associations, including the International Franchise Association, to achieve mutual goals.
Code of Ethics
As a condition of membership in the Association, each Member must pledge continuing adherence to the following Code of Ethics:
A. In the advertisement and grant of franchises, a Member shall comply with all applicable laws and regulations, and the Member’s offering circulars, if required by law shall be complete, accurate and not misleading with respect to the franchisee’s investment, the obligations of the Member and of the franchisee under the agreement and all material facts relating to the franchise.
B. All matters material to the Member’s franchise shall be contained in one or more written agreements, which shall clearly set forth the terms of the relationship and the respective rights and obligations of the parties.
C. A Member shall select and accept only those franchisees who, upon reasonable investigation, appear to posses the basic skills, education, experience, personal characteristics, and financial resources requisite to conduct the franchised business and meet the obligations of the franchisee under the agreement(s). There shall be no discrimination in the granting of franchises based solely on race, color, religion, national origin, or sex. However, this in no way prohibits a Member from granting licenses or franchises as part of an affirmative action program to make them available to persons lacking the capital, training, business experience, or other qualifications ordinarily required.
D. A Member shall provide reasonable guidance to its franchisees in a manner consistent with its agreement(s).
E. Fairness shall characterize all dealings between a Member and its or franchisees. A Member shall make every good faith effort to resolve complaints by and through direct communication and negotiation. To the extent reasonably appropriate under the circumstances, a Member shall give its licensee or franchisee notice of, and a reasonable opportunity to cure, a breach of any contractual relationship.
F. No Member shall engage in the pyramid system of distribution. A pyramid is a system wherein a buyer’s future compensation is expected to be based primarily upon recruitment of new participants, rather than upon the sale of products or services.
G. Affiliate Members shall use their best efforts to learn, inform, and teach franchisors and others, where appropriate, current applicable law and regulations with respect to franchising, to encourage full compliance with all such laws and regulations and with this Code of Ethics and to promote good business practices.
